In principle, therefore, service providers such as software suppliers and affiliates are free to provide their services to locally licensed remote gambling operators. Licensed operators will be responsible for ensuring that all suppliers comply with regulatory requirements flowing from the Dutch regulatory regime. The new Enforcement Policy Rules and Fining Policy Rules have been in force since 1 October 2021, specifically in relation to unlicensed operators. In 2023, the NGA imposed an administrative fine of EUR675,000 upon an entity advertising locally unlicensed remote gambling offers. This entity was previously served with a cease-and-desist order, which was ignored. The current vision dates from 2011 and assumes a large personal responsibility for players and providers.

Criminal law-based enforcement is the sole competence of the public prosecutor and criminal sanctions can consist of a fine, imprisonment and community service. The specific circumstances in which criminal law can be used are set out in the enforcement protocol between the NGA and the public prosecutor. This will apply upon the licence being applied for but can also be applied during the lifetime of the licence. The non-incidental games of chance licences have a duration of up to five years commencing on the date of award.

Additional protective measures

The number of active player accounts grew from 970,000 to 1.1 million in one year. On October 1st 2024, the Remote Gambling Act (the Koa Act) will have existed in the Netherlands for exactly three years. The contours of umbrella playing limits have been worked out and are outlined in more detail in the annex to this letter. In performing its enforcement duties, the NGA has discretion with regard to the moment at which it launches enforcement investigations. For all readily available licences (except remote games of chance), the watershed period for gambling advertisements on television and radio is between 6am and 9pm. Applicants must submit an advertising policy to the NGA as part of the remote gambling licence application process. This document will describe the applicant’s approach to shaping advertisements and engaging with third parties such as affiliates. Furthermore, the advertising policy will detail how the marketing team of an applicant is organised. The above-mentioned reliability assessment for remote gambling applicants does not apply to land-based slot-machine (exploitation) licence applications and charity lottery licence applications.

In terms of enforcement, the powers of the Ksa will be expanded to be able to take better action against illegal providers. The ROK contains advertising restrictions, which are additional to those found in Dutch gambling legislation, such as an explicit cap on the amount of a welcome bonus. In addition, licensees are not permitted to offer remote games in which a player can lose more than they have staked (e.g., spread betting). The Dutch State Secretary of Justice is going to fundamentally change the rules for online gambling in the Remote Gaming Act.

State Senator Devlin Robinson issued a statement touting the fact that two of his own funding priorities — for literacy programs and for first responders — were included. Sen. Dawn Keefer (R-York) spoke out against the deal in a floor speech Wednesday afternoon. In a recent interview, she said many of the legislature’s most conservative members hoped to keep spending at last year’s number, under $48 billion, to reduce the deficit between spending and revenue. Republican leaders had warned that Democrats sought to spend more than they expect to bring in from taxes and other revenue sources — a deficit the state will plan to cover by drawing on funding reserves. The deal now pending in Harrisburg does just that, leaving the state with only a $200 million fund balance. House Republican leader Jesse Topper urged GOP members to vote for the package of bills, pointing to a yearslong push to repeal RGGI.

Among other things the measures cover the setting of a responsible spending limit and the obligation of contact with the gambling provider whenever a player wants to increase the deposit limit. Another new measure ensures that players fill in a spending limit in a neutral environment, without any pre-filled options or advertising. The measures are a result of the Regulation on Spending Limits and More Conscious Gambling Behaviour (Regeling speellimieten en bewuster speelgedrag).
